§ 2 DEFINITIONS

Blog – an Electronic Service, an internet blog available on the Website for its Customers, enabling access to articles and analyzes.

Product – a product or service provided by the Service Provider, in particular training available on the Website, an electronic course or a subscription enabling joining an educational group, which may be or constitute the subject of a Sales Agreement between the Service User and the Service Provider. The website does not contain recommendations within the meaning of the Regulation of the Minister of Finance of October 19, 2005 on information constituting recommendations regarding financial instruments, their issuers.

Electronic service – a service provided electronically by the Service Provider to the Service Recipient / Consumer via the Website in accordance with the Regulations.

Copyrights – the Act on Copyright and Related Rights of February 4, 1994 (Journal of Laws No. 24, item 83, as amended)

Account – a free Store function regulated by separate regulations (a service provided electronically), thanks to which the Buyer may set up his individual Account in the Store. The Account also enables the use of other Electronic Services available on the Website – in the case of which the requirement to first create an Account has been indicated.

Working days – days from Monday to Friday, except public holidays.
Consumer – a consumer within the meaning of the Civil Code.
Buyer – any Buyer in the Store.
Regulations – these regulations.

§ 3 ELECTRONIC SERVICES ON THE WEBSITE

  1. Each Service Recipient may use the Website on the terms specified in the Regulations.
  2. The Service Recipient may use the following Electronic Services on the Website:

  4. Account (Profile);
  5. Newsletter;
  6. Product Store;
  7. A detailed description of Electronic Services and the rules of their operation is available in the Regulations and on the Website.
  8. The Seller is obliged to provide Electronic Services without defects.

§ 4 COPYRIGHT

  1. Copyrights and intellectual property rights to the Website as a whole and its individual elements, including content, graphics, works, designs and signs available on it, belong to the Service Provider or other authorized third parties and are protected by Copyright and other generally applicable provisions rights.
  2. The Service Recipient has no right to copy, modify, adapt, translate or distribute the Website or the Products, except for cases permitted by the provisions of mandatory law.

§ 5 BLOG

Browsing the Blog available on the Website is free of charge.

Viewing the Blog itself is possible after going to the appropriate tab of the Website. The Service Recipient may at any time and without giving a reason to stop browsing the Blog by closing the web browser.

The blog is available by default to all visitors to the Website.

§ 7 TECHNICAL REQUIREMENTS

  1. For the proper functioning of the Store, you need:

  • A device with Internet access
  • A web browser that supports JavaScript and cookies.
  • To place an order in the Store, in addition to the requirements set out in paragraph 1, an active e-mail account is required.

§ 8 GENERAL CONDITIONS AND IN-STORE PURCHASES

  1. The prices of goods visible in the Store are the total prices for goods and services, including VAT.
  2. The Seller points out that the total price of the order consists of the price for the goods indicated in the Store and, if applicable, the costs of delivery of the goods.
  3. The product selected for purchase should be added to the basket in the Store.
  4. Then, the Buyer selects from the available in the Store: the method of delivery of the goods and the method of payment for the order, and also provides the data necessary to complete the order.
  5. The order is placed upon confirmation of its content and acceptance of the Regulations by the Buyer.
  6. Placing an order is the same as concluding a sales contract between the Buyer and the Seller.
  7. The Seller will provide the Consumer with confirmation of the conclusion of the sales contract on a durable medium at the latest upon delivery of the goods.
  8. The Buyer may register in the Store, i.e. create an Account in it or make purchases without registration by providing his data with every possible order.
  9. The Service Recipient is obliged to use the Website in a manner consistent with the law and morality, with respect for personal rights as well as copyrights and intellectual property of the Service Provider and third parties. The Service Recipient is obliged to enter data consistent with the facts. The Service Recipient is forbidden to provide illegal content.
  10. Training available on the Website should not be treated as signals to conclude transactions on the capital market.
  11. The use of the order form begins when the Customer selects the Product. The order is placed after the Customer completes two consecutive steps – (1) completing the order form, (2) clicking on the Store’s website after completing the order form, the “Buy and pay” field (3) confirming that he has read and accepted the regulations in the indicated field ( checkbox) – up to this point there is a possibility independent modification of the entered data (to do this, follow the displayed messages and information available on the Store’s website) In the order form, it is necessary for the Customer to provide the following data regarding the Customer: name and surname / company name, e-mail address, contact telephone number and data regarding the sales contract: Product / s, quantity of Product / s, place and method of delivery of the Product / s, payment method. In the case of Customers who are not consumers, it is also necessary to provide the company name and tax identification number.
  12. The price of the Product shown on the Store’s website is given in USD and includes taxes. The Service Recipient is informed about the total price including taxes of the Product being the subject of the order on the Store’s website when placing the order, including when the Customer expresses his will to be bound by the Sales Agreement.
  13. Consolidation, protection and provision of content to the Service User the concluded sales contract takes place by (1) making these Regulations available on the Website and (2) sending the Customer an e-mail after the purchase. The content of the sales contract is additionally recorded and secured in the IT system of the Service Provider’s Website.

§ 9 PAYMENT

You can pay for your order via the payment platform:

  1. Cryptocurrency
  2. If the Buyer selects payment in advance, the order must be paid within 24 hours of placing the order.
  3. The seller informs that in the case of some payment methods, due to their specificity, payment for the order with this method is possible only immediately after placing the order.
  4. By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller.
  5. The buyer has the right to withdraw his acceptance by sending an email to contact@mradvice.eu.

§ 10 EXECUTION OF THE CONTRACT

  1. The order completion date is indicated in the Store.
  2. In the event that the Buyer has chosen to pay in advance for the order, the Seller will proceed with the order after paying for it.
  3. In a situation where, under one order, the Buyer has purchased goods with different delivery dates, the order will be processed on the date appropriate for the goods with the longest delivery date.
  4. The goods are delivered only on the territory of the Republic of Poland.
  5. Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:
  6. Via a courier company
  7. Via electronic access

§ 11 RIGHT TO WITHDRAW FROM THE CONTRACT

  • After purchasing an access to Mr.Advice’s group and digital materials (courses, video materials), the consumer has no right to withdraw from the contract.

§ 12 PERSONAL DATA

  1. The administrator of the personal data provided by the Buyer when using the Store is the Seller.
  2. The Buyer’s personal data is processed on the basis of a contract and for its implementation, in accordance with the principles set out in the general regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on data processing by the Seller is included in the privacy policy posted in the Store.

§ 13 RESERVATIONS

  1. The Buyer is forbidden to provide illegal content.
  2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the regulations. The contract is concluded on time and to fulfill the order.
  3. Agreements concluded on the basis of these regulations are concluded in English language.
  4. In the event of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the seat of the Seller.
  5. Nothing in these regulations excludes or in any way limits the consumer’s rights under the law.
  6. Provisions regarding goods shall apply accordingly to digital content, unless the Regulations specify these issues separately.

§ 4 COPYRIGHT

  • Copyrights and intellectual property rights to the Website as a whole and its individual elements, including content, graphics, works, designs and signs available on it, belong to the Service Provider or other authorized third parties and are protected by Copyright and other generally applicable provisions rights. The protection granted to the Website covers all forms of their expression.
  • The Service Recipient has no right to copy, modify, adapt, translate or distribute the Website or the Products, except for cases permitted by the provisions of mandatory law.
  • Trademarks of the Service Provider and third parties should be used in accordance with applicable law.

§ 5 ACCOUNT

  1. Creating an Account is completely voluntary and depends on the will of the Buyer.
  2. The account gives the Buyer additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of the order or editing the Buyer’s data, and access to paid materials related to the delivery of Electronic Services.
  3. In order to create an Account, you must complete the appropriate form in the Store.
  4. At the time of creating the Account, an agreement is concluded for an indefinite period between the Buyer and the Seller in the scope of keeping the Account on the terms specified in the Regulations.
  5. The buyer may cancel the account at any time without incurring any costs.
  6. In order to cancel the Account, please send your resignation to the Seller at the following e-mail address: contact@mradvice.eu, which will result in immediate deletion of the Account and termination of the Account maintenance contract.

§ 6 COMPLAINTS

  1. Complaints regarding the functioning of the Account should be sent to the e-mail address kontakt@mradvice.eu
  2. Consideration of the complaint by the Seller will take place within 14 days.


EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND PURSUING CLAIMS

  1. In the event that the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, inter alia, with:
  2. Mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to which you should apply for mediation. As a rule, the procedure is free of charge. The list of Inspectorates is available here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
  3. Assistance of the competent local permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which an application should be submitted for consideration of the case before the arbitration court.   4. ODR internet platform available at: http://ec.europa.eu/consumers/odr/.

§ 7 PERSONAL DATA

  1. The administrator of the personal data provided by the Buyer when using the Store is the Seller.
  2. The Buyer’s personal data is processed on the basis of a contract and for its implementation, in accordance with the principles set out in the general regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on data processing by the Seller is included in the privacy policy posted in the Store.

§ 8 RESERVATIONS

  1. The Buyer is forbidden to provide illegal content.
  2. The Account maintenance agreement is concluded in Polish.
  3. In the event of important reasons, referred to in paragraph. 4, the Seller has the right to amend these Account Regulations.
  4. Important reasons, referred to in paragraph. 3 are:
  5. the need to adapt the Store to the legal provisions applicable to the Store’s operations
  6. improving the security of the service provided
  7. changing the functionality of the Account that requires modification of the Account regulations.
  8. The buyer will be informed about the planned change to the Account regulations at least 7 days before the change is implemented via an e-mail sent to the address assigned to the Account.
  9. If the Buyer does not accept the planned change, he should inform the Seller about it by sending an appropriate message to the Seller’s e-mail address contact@mradvice.eu, which will result in the termination of the contract in the scope of Accounts upon the entry into force of the planned change or earlier, if the Buyer so requests.
  10. If the Buyer does not object to the planned change until its entry into force, it is assumed that he accepts it, which does not constitute any obstacle to termination of the contract in the future.
  11. In the event of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the seat of the Seller.
  12. Nothing in these regulations excludes or in any way limits the consumer’s rights under the law.
